PERUNDINGAN BIPARTIT WAJIB DILAKUKAN SEBELUM UPAYA MEDIASI, KONSILIASI, ARBITRASE, DAN PADA PENGADILAN HUBUNGAN INDUSTRIAL

Abstract


This research aims to find out the procedures for resolving industrial relations disputes. Based on the results of the study it was concluded that in industrial relations it is mandatory to seek a bipartite agreement. If the bipartite issue fails, then there are efforts that can be made by the disputing parties either due to rights disputes, conspiracy, cessation of termination of employment, or binding between unions within one company, and among them are mediation, conciliation, arbitration, and settlement of industrial relations disputes. However, these efforts can be made if a bipartite agreement has been made by the parties. If a bipartite agreement can reach an agreement settlement, a Collective Agreement is made which is signed by the parties, is binding, and becomes law, and must be implemented by the parties.
